Happy Tuesday!
JOHN’S GEORGIA TIP OF THE WEEK: How Do I Calculate the Claimant’s Average Weekly Wage?
- The Average Weekly Wage (AWW) is the Claimant’s average gross earnings during the 13 weeks immediately preceding the date of accident.
- If the Claimant did not work “substantially the whole of 13 weeks the injury,” the AWW is calculated by using the wages of a “similarly situated employee” who DID work substantially the whole of such 13 weeks.
- If either of the methods listed above “cannot reasonably and fairly be applied, the AWW is calculated using the Claimant’s full-time weekly wage at the time of hiring (their hourly rate x the number of hours the Claimant was hired to work each week).
As always, feel free to call/email if you have any questions or run into any issues.
Sincerely,
John Fennelly | Georgia Attorney
