By special request, this week covers how to file the WC-104 if the Claimant has already been released from medical treatment:

JOHN’S GA TIP OF THE WEEK: Can I File the WC-104 If the Claimant Has Already Been Released from Medical Treatment?

§  The WC-104 reduces:

1)      the lifetime of the claim from 400 weeks to 350 weeks, and

2)      the Claimant’s TTD benefits to TPD benefits ($533.00) after 52 weeks of light duty.

§  To be valid:

1)      the WC-104 must be filed within 60 days of the light duty release from the ATP, and

2)      A copy of the light duty release must be attached to the WC-104

§  Can I File the WC-104 If the Claimant Has Already Been Released from Medical Treatment?

  • YES!
  • You will need to schedule a follow-up appointment with the ATP to obtain an updated light duty release (and file the WC-104 within 60 days)
  • The cost of the follow-up appointment will be MUCH CHEAPER than an ADDITIONAL 50 WEEKS OF INCOME BENEFITS the Claimant will receive without filing the WC-104!
